Terms & Conditions

  1. GENERAL
    These Terms & Conditions apply to all photography and creative services provided by Simon Buser.
    By requesting a quotation or booking a service, you agree to these terms.

  2. QUOTATIONS & BOOKINGS
    All quotations are valid for the period stated in the offer.
    A booking becomes binding once the quotation has been accepted in writing or confirmed via email or message.
    The scope of work is defined exclusively by the accepted quotation and any written agreements between both parties.

  3. SERVICES
    Depending on the project, services may include:
    Photography
    Creative Direction
    Production planning
    Image selection
    Professional editing
    Digital delivery
    Licensing of the final images
    Any services not explicitly stated in the quotation are not included.

  4. PRICING & PAYMENT
    All prices are stated in the agreed currency and exclude VAT where applicable.
    Invoices are payable within 30 days, unless agreed otherwise.
    For productions exceeding CHF 2,000, a 50% deposit may be required to secure the booking.

  5. TRAVEL & ADDITIONAL COSTS
    Travel expenses and additional production costs will be charged as outlined in the quotation.
    Additional shooting or working time beyond the agreed scope may be billed separately.

  6. DELIVERY
    Final images are delivered digitally within the timeframe agreed upon in the quotation.
    Delivery is typically provided through an online gallery or download link.
    Should unforeseen circumstances delay delivery, the client will be informed as soon as possible.

  7. EDITING
    All photographs are edited in Simon Buser's signature style.
    Unless agreed otherwise, creative decisions regarding image selection, colour grading, cropping and overall editing remain at the photographer's discretion.
    Additional editing or retouching requests may incur extra charges.

  8. RAW FILES
    RAW files remain the property of the photographer and are not included in the delivered material unless agreed otherwise in writing.

  9. USAGE RIGHTS
    Usage rights are granted only after full payment and are limited to the scope defined in the quotation.
    Any additional commercial use, including advertising campaigns, paid social media advertising, sublicensing or distribution to third parties, requires prior written approval and may be subject to additional licensing fees.

  10. COPYRIGHT & PORTFOLIO USE
    Copyright always remains with Simon Buser.
    Unless otherwise agreed, Simon Buser reserves the right to use commissioned work for:
    • Portfolio
    • Website
    • Social Media
    • Awards & Exhibitions
    • Self-promotion
    Images will never be commercially licensed or sold to third parties without prior consultation with the client.
    If confidentiality is required, this can be agreed upon before the project begins.
    Whenever reasonably possible, crediting Simon Buser or @simonbuser_ is appreciated.

  11. EXCLUSIVITY
    Unless explicitly stated in the quotation, no exclusive usage rights are granted.
    Exclusive licenses or complete transfer of rights require a separate written agreement.

  12. FILE STORAGE
    RAW files are archived for one month after project completion.
    Final edited images are generally stored for up to six months.
    Clients are responsible for creating their own backups after delivery.

  13. CLIENT RESPONSIBILITIES
    The client agrees to provide all necessary information, approvals and feedback in a timely manner.
    Delays caused by missing information or late approvals may affect delivery times and may result in additional costs.

  14. CANCELLATIONS
    If a booking is cancelled, work already completed and any third-party expenses will be charged.
    A cancellation fee of up to 20% of the agreed project value may apply.

  15. FORCE MAJEURE
    The photographer cannot be held responsible for delays or cancellations caused by circumstances beyond reasonable control, including severe weather, travel disruptions, government restrictions or other force majeure events.

  16. AI USAGE
    Delivered images may not be used for training artificial intelligence models or incorporated into AI datasets without prior written permission.
    The use of AI-assisted editing tools within the client's internal workflow is permitted, provided that the images are not used to train or improve AI systems.

  17. PRIVACY
    Personal information is used solely for the purpose of completing the project and will not be shared with third parties unless required for project execution or by law.

  18. CHANGES TO THESE TERMS
    These Terms & Conditions may be updated from time to time.
    The latest version will always be available on this website.

  19. GOVERNING LAW
    These Terms & Conditions are governed by the laws of Switzerland.
    The place of jurisdiction is Baden (AG), Switzerland.
